आपसी सहमती से पारिवारिक बटवारा विलेख

..................... समस्त जाति ............. समस्त निवासीगण ग्राम ................ तहसील
व जिला ................................ मूल निवासी है तथा हम सब की आपसी
सहमती से यह बटवारा विलेख निम्नानुसार निष्पादित करते है कि :-
1. यह कि हमारे पिता श्री ........................ के हक अधिकार अधिपत्य की पैतृक
हवैली एवं एक आवासीय भूखण्ड जो वाकै ग्राम .......................... तहसील व
जिला .............................. में अवस्थित है।
2. यह कि हमारे पिता श्री ............................. के मालिकाना हक अधिकार की
पैतृक हवेली व एक किता भूखण्ड में हमारे पिता जी के हम सभी भाई
संयुक्त रूप से अपने परिवार के साथ आवास निवास करते थे। यह कि
हमारे पिता श्री ............................. की मृत्यु के पश्चात हम सभी भाई उक्त हवेजी
व एक किता भूखण्ड के औपचारिक वारिसान है जो कि हम सभी भाईयो
ने राजीपेटे व बिना किसी दबाव के उक्त पैतृक हवेली एवं आवासीय
भूखण्ड का आपस मे मिल बैठकर आपसी सहमती से बटवारा कर लिया
था।
3. जो कि हम ..................................................... ने आपसी सहमती
से उक्त भूखण्ड मे अपना हक हिस्सा त्याग कर उक्त आवासीय भूखण्ड
सम्पूर्ण को अपने भाई ................................ को प्रदान कर दिया है उक्त उक्त आवासीय भूखण्ड पर ......................................... का उक्त आवासीय सम्पूर्ण
भूखण्ड पर हक अधिकार कब्जा हो गया है कि वह उक्त भूखण्ड को चाहे
विक्रय करे, रहन रखे, मकान बनावे, आवास निवास करे, या अपनी
आवश्यकता अनुसार उपयोग उपभोग में लावे तथा भविष्य मे जब भी
............................ द्वारा कहा जायेगा हम उस के पक्ष मे उक्त भूखण्ड का समोचन
पत्र निष्पादित करवा देगे। यह कि उक्त ................................. द्वारा हमारे पिता जी
की एक अन्य सम्पति एक पैतृक हवेली मे से किसी भी प्रकार का कोई
हक अधिकार की मांग नही करेगा अर्थात उक्त .............................. द्वारा उक्त
हवेली मे से अपने हक हिस्सा का त्याग कर दिया गया है।
4. जो कि उक्त आवासीय हवेली मे से ........................ ने अपने 1/4 हक
हिस्से को श्री ................. जी को मौखिक विक्रय कर अपने हक हिस्से के
बाबत सम्पूर्ण प्रतिफल राशि प्राप्त कर लि है तथा भविष्य मे हम उप
पंजीयक के यहा उपस्थित होकर सहमती से उक्त विक्रय पत्र को पंजीकृत
करवा लेंगे। जो कि उक्त आवासीय हवेली पर ....................................... का स्वयं का 1/4
हक हिस्सा व ...................................... मल से प्राप्त 1/4 हक हिस्सा अर्थात उक्त हवेली
पर बेगाराम का 1/2 हक हिस्सा है जिसे उक्त बेगाराम जैसे चाहे वैसे
उपयोग उपभोग करे हमे इसमे किसी भी प्रकार की कोई आपत्ति एवं
एतराज नही है।
5. जो कि उक्त आवासीय हवेली पर ............................................... का प्रत्येक
का 1/4 हक हिस्सा है। जिसे वे जैसे चाहे वैसे उपयोग उपभोग करे
इसमे किसी भी भाई के द्वारा कोई आपत्ति व एतराज नही किया जावेगा।
6. यह कि उक्त आवासीय हवेली पर हम तीनों भाईयो का .......................... का
1/2 हक हिस्सा, दल्लाराम का 1/4 हक हिस्सा व ............................... का
1/4 हक हिस्सा है। जो कि उक्त हवेली मे हमारे भाई ........................... के
हिस्से के जगह कुंदन मल को अपने हिस्से की विक्रय राशि अदा कर दि
गयी है तथा हमारे भाई ................................. को हमारे पिता जी के हक अधिकार का
एक किता आवासीय भूखण्ड प्रदान कर दिया गया है जिसमे हम ने अपना
हक हिस्सा शुन्य कर लिया है। अब हम तीनो भाईयो के अलावा हमारे
अन्य किसी भी भाई का उक्त हवेली पर कोई हक हिस्सा नही है तथा
भविष्य मे उक्त हवेली मे हक अधिकार के बाबत किसी भी प्रकार का वाद
विवाद या कानूनी कार्यवाही हमारे उक्त भाई या उनके वारिश नही करेंगें ।
7. यह कि उक्त आवसीय हवेली मे ............................... जी का अविभाजित 1/2 हक
हिस्सा है ........................... जी के उक्त हवेली के 1/2 हक हिस्से में से ................................ के तीनों पुत्रों .......................................................... का प्रत्येक का
बराबर-बराबर हक हिस्सा है अर्थात ........................ जी के 1/2 हक हिस्से मे
से पुत्र ................................... का 1/3 हक हिस्सा (अर्थात 1/6 हक हिस्सा),
............................... का 1/3 हक हिस्सा (अर्थात 1/6 हक हिस्सा) व ....................................... का 1/3 हक हिस्सा (अर्थात 1/6 हक हिस्सा) समान रूप से है।
8. यह कि उक्त आवासीय हवेली एवं आवासीय भूखण्ड को हमने आपसी
बटवारे बाबत उक्त विलेख तहरीर एवं तकमील की गई है जो हम सभी ने
अपनी स्वतन्त्र इच्छा एवं सहमती से निष्पादित की है जिसमे हम सभी भाई
तथा हमारे वारिसो की सहमती है तथा हम सभी भाई तथा हमारे वारिस उक्त विलेख मे वर्णित हक हिस्से के अतिरिक्त हक हिस्से का विवाद
भविष्य मे नही करेंगे। हम सभी ने उक्त विलेख सोच समझ कर पढ़ सुन
कर बिना किसी जोर दबाव मे अपने हस्ताक्षर व अंगुठा निशानी अंकित
कर दिये है जो वक्त जरूरत काम आवे ।
अत यह आलेख बटवारानामा हम भाईयों ने परिवारजनो की
सहमती से पूरे होशहवास में बिना किसी नशे पते व बिना किसी दबाब
नाजायज के सक्षम साक्षियान की उपस्थिति में तहरीर एवं तकमील कर
दिया कि सनद रहे व समय पर काम आवे ।

Family partition deed by mutual consent
We, the names ...................................................................................... all sons ..................... all castes ............. all residents of village ................ tehsil and district ................................ are original residents and with our mutual consent we execute this partition deed as follows:-
1. That our father Shri ........................ has the right to the ancestral mansion and a residential plot situated in village .......................... tehsil and district ..............................
2. That all of us brothers of our father jointly resided with our families in the ancestral mansion and a plot of land owned by our father Shri ............................. That after the death of our father Shri ............................., all of us brothers are the formal heirs of the said mansion and a plot of land, which all of us brothers had divided by mutual consent of the said ancestral mansion and residential plot by sitting together and without any pressure.
3. That we ..................................................... have, by mutual consent, relinquished our share in the said plot and handed over the entire said residential plot to our brother ................................. .................................................... has got the right over the entire said residential plot that he may sell the said plot, mortgage it, construct a house, reside in it, or use it as per his requirement and in future whenever asked by .................................. we will get the conveyance letter of the said plot executed in his favour. That the said ................................. will not demand any right of any kind in our father's other property, an ancestral mansion, i.e. the said .............................. has relinquished his share in the said mansion.
4. In the said residential mansion, .................................. has verbally sold his 1/4th share to Mr. ................ and has received the full consideration for his share and in future we will appear before the sub-registrar and get the said sale deed registered with our consent. In the said residential mansion, .................................. has his own 1/4th share and 1/4th share received from .................................................. the owner has 1/2 right share on the said mansion which the owner can use as he wishes and we have no objection or objection of any kind in this regard.
5. In the said residential mansion, ............................................... has 1/4th share each. They can use it as they wish and no objection or objection will be raised by any brother in this regard.
6. That we three brothers have 1/2 right share of .........................., 1/4 right share of Dallaram and 1/4 right share of ............................... in the said residential mansion. In place of our brother ...........................'s share in the said mansion, Kundan Mal has been paid the sale amount of our share and our brother ................................ has been given a residential plot of our father's right in which we have made our right share zero. Now apart from us three brothers, none of our other brothers has any right share on the said mansion and in future our said brothers or their heirs will not initiate any dispute or legal action regarding the right to the said mansion.
7. That ...............................ji has undivided 1/2 right share in the said residential mansion. Out of the 1/2 right share of the said mansion of ................................ji, each of the three sons ................................................................ has equal right share i.e. out of the 1/2 right share of ..........................ji, son ................................... has 1/3 right share (i.e. 1/6 right share), ............................... has 1/3 right share (i.e. 1/6 right share) and ................................................. has 1/3 right share (i.e. 1/6 right share) equally.
8. That we have written and completed the said deed regarding mutual partition of the said residential mansion and residential plot with our free will and consent, to which all of us brothers and our heirs agree and all of us brothers and our heirs will not dispute the right share other than the right share mentioned in the said deed in future. We all have read and listened to the above document carefully and have put our signatures and thumb impressions without any pressure so that it may be useful at the time of need. Hence, we brothers have written and completed this partition document with the consent of our family members in full senses, without any intoxication, without any pressure or illegality in the presence of competent witnesses so that it remains as a record and may be useful at the time of need.
