धारा 6. दण्डावधियों की भिन्ने- दण्डावधियों की भिन्नों का गणना करने में, अन्यथा उपबंधित के सिवाय, आजीवन कारावास को बीस वर्ष के
कारावास के समतुल्य गिना जाएगा।
विस्तार पूर्वक से समझे :
- दण्डावधियों की भिन्ने: भारतीय न्याय संहिता, 2023 की धारा 6, दण्ड की अवधि के अंशों की गणना के लिए नियम निर्धारित करती है
- आजीवन कारावास कि सजा या दंड : दंड की अवधि के अंशों की गणना करते समय, आजीवन कारावास को बीस वर्ष के कारावास के समतुल्य माना जाएगा, जब तक कि अन्य कहा पे प्रावधान न किया गया हो
- उदाहरण से समझे : यदि किसी व्यक्ति को आजीवन कारावास की सजा सुनाई जाती है, और बाद में उसे सजा की अवधि का कुछ हिस्सा माफ कर दिया जाता है, तो इस माफ किए गए हिस्से की गणना करते समय आजीवन कारावास को 20 साल के कारावास के बराबर माना जाएगा
Section 6. Fractions of terms of punishment.-
In calculating fractions of terms of
punishment, imprisonment for life shall
be reckoned as equivalent to
imprisonment for twenty years unless
otherwise provided.
Understand the details vaguely:
- Fractions of sentence periods: Section 6 of the Indian Justice Code, 2023, lays down rules for calculating fractions of the term of sentence
- Sentence or punishment of imprisonment for life: While computing the fractions of the term of punishment, imprisonment for life shall be deemed to be equivalent to imprisonment for twenty years, unless otherwise provided.
- Understand by example: If a person is sentenced to life imprisonment, and later some part of the sentence period is pardoned, then while calculating this pardoned part, life imprisonment will be considered equal to 20 years of imprisonment.
